Agreement to Terms

By using our website www.luxdentallab.com (“Site”) or submitting a prescription (Rx) — whether signed or unsigned, for physical or digital impressions/cases — you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you should not use our Site or submit prescriptions/orders to us.

Intellectual Property Rights

All content on the Site, including text, graphics, logos, and images, is the property of LUX Dental Lab, LLC and is protected by applicable intellectual property laws. You may not use any content from our Site without prior written permission.

Prosthetic and Removable Restorations Guarantee

LUX Dental Lab, LLC provides a one-year guarantee to active accounts on all prosthetic and removable restorations. This guarantee covers defects in materials and workmanship and is effective from the date of the order. It applies only when products are used in accordance with standard dental practices.

We reserve the right to decline our guarantee on any case after investigating the reported issue. No guarantee is offered to offices that are not currently active accounts. All remakes are subject to full payment unless otherwise determined at our discretion.

Prescription (Rx) Submission

When you submit a prescription (Rx) to us — whether signed by the prescribing dentist or not — you represent that you have the authority to make such a submission and that all information provided is accurate and complete. LUX Dental Lab, LLC is not responsible for verifying the authority of individuals submitting prescriptions.

Payment Terms

Payments are due upon receipt. Any balance unpaid after the 15th of the month will incur a 10% late fee. Payments are not invoiced monthly but are billed with each shipment of goods.

A valid credit card must be kept on file as a condition of service unless alternative arrangements are approved by management. We reserve the right to charge the card on file for services rendered or products provided.

Refunds and Credits

We do not offer refunds. Credits may be issued at the discretion of LUX Dental Lab, LLC management and will be applied to the customer’s account for future use. No cash refunds will be given.

Chargebacks

Unauthorized chargebacks are not permitted and may result in termination of services or legal action. Written approval from LUX Dental Lab, LLC is required for any chargeback. Customers who initiate unauthorized chargebacks may be held liable for all related legal costs.

Arbitration

By using our services, you agree that any dispute, claim, or controversy arising out of or relating to these Terms and Conditions, your use of our services, or their enforcement shall be resolved by binding arbitration. Arbitration will be administered by the American Arbitration Association (AAA) or another mutually agreed provider.

Unless otherwise agreed, arbitration shall take place in Salt Lake County, Utah. Judgment on the arbitration award may be entered in any court with jurisdiction. The arbitrator shall have exclusive authority to resolve any dispute regarding the interpretation, enforceability, or validity of this agreement, including claims that any part is void or voidable.

You and LUX Dental Lab, LLC expressly waive the right to a jury trial or to participate in a class action or class arbitration. This arbitration agreement is governed by the laws of the State of Utah.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Utah. Any disputes arising hereunder will be subject to the exclusive jurisdiction of courts located in Utah.

Limitation of Liability

LUX Dental Lab, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any prescription submitted, whether signed or unsigned.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Continued use of the Site or submission of prescriptions following such changes constitutes acceptance of the updated Terms.
